The short version

  • You write the note, and it stays yours. We turn it into a card and keep it at a private link.
  • Every purchase is final. We don’t give refunds. If something breaks on our side, we’ll fix it or give you a new card for free.
  • Anyone with a card’s link can open it. Anyone with your edit link can change it, so keep that one to yourself.
  • Be kind. We take down cards meant to hurt, harass or deceive.
  • These terms are governed by the laws of Ontario, Canada.

These terms

These terms are the agreement between you and Kindnotes (“we”, “us”, “our”). They apply when you use the Kindnotes website, make or buy a card, or open one. By using Kindnotes, you agree to them. If you don’t agree, please don’t use Kindnotes.

Our Privacy Policy explains how we handle personal information, and it forms part of these terms.

What Kindnotes is

Kindnotes makes handcrafted digital cards. You pick a design, add names and a note, and pay once. We then give you two private links: one to send to the person the card is for, and one for you to make changes. There’s no app to install and no account to create.

Who can use Kindnotes

You must be at least 13 to use Kindnotes. If you’re under the age of majority where you live (18 in most places), you need a parent or guardian’s permission to buy a card. By giving it, they accept these terms for you.

Buying a card

  • Prices are shown in US dollars before you pay, plus any taxes that apply where you live. Your bank may add its own currency conversion fees.
  • Payments are processed by Stripe, and Stripe’s own terms apply to the payment. We never see or store your full card number.
  • Your purchase is complete once your payment goes through. Your card is ready immediately. We show you its links on screen and email them to the address you gave us.
  • We may change our prices at any time. A price change never affects a card you’ve already bought.

All sales are final

Every purchase on Kindnotes is final, and we don’t offer refunds or exchanges. Your card is made and delivered the moment you pay. That includes cases where:

  • you change your mind, or the occasion changes
  • the person you sent it to doesn’t open it, or opens it later than you hoped
  • you spot a typo or want to say something different (you can change the note yourself with your edit link)
  • you sent the link to the wrong person, or someone else got hold of it

If something goes wrong on our side

Sometimes a card won’t work because of a problem with Kindnotes. For example, the link might not open, or the card might not display properly on a current phone or browser. If that happens, email kindnotesapp@gmail.com within 30 days of buying the card. We’ll fix it. If we can’t, we’ll give you credit for a new card of the same design, free. Credit has no cash value and can’t be exchanged for money.

Charged twice by mistake

If a billing error charged you more than once for the same card, we’ll refund the extra charges.

Cancellation periods

In some places, such as the European Union and the United Kingdom, buyers normally have 14 days to cancel an online purchase. Because your card is delivered immediately, when you pay you ask us to start right away. You also acknowledge that you lose that right to cancel once the card has been made.

Your rights under the law

Some laws give buyers rights that a business can’t take away, such as the consumer guarantees under the Australian Consumer Law or consumer protection laws in Canada. Nothing in these terms limits those rights. Where the law requires us to give a refund, we will.

Disputed payments

If you think a charge is wrong, please email us before you contact your bank. It’s usually faster. If a payment is disputed or reversed, we may disable the card it paid for.

Your card and its links

  • The card link. Your card lives at a long, random link that can’t practically be guessed. Anyone who has the link can open the card, so share it only with the person it’s for. We don’t list cards publicly, and we ask search engines not to index them.
  • The edit link. Your edit link lets whoever has it change the card. Treat it like a password. If you lose it, email us from the address you used to buy the card and we’ll do our best to help.
  • Changes. You can change the note and details after you buy. Your changes appear at the same card link.
  • How long cards last. We mean for your card to stay open for good, but we can’t promise Kindnotes will run forever. If we ever have to shut it down, we’ll email everyone we have an address for at least 30 days beforehand, so you have time to save your card.
  • Improvements. We may update how cards look or work, for example to fix bugs or support new devices. We won’t change the words you wrote.

What you write

  • Your words are yours. You keep ownership of everything you put in a card.
  • What we need from you. You give us permission to store, copy, format and display what you write, only so we can run Kindnotes. That means showing the card to people with its link, showing you previews, and sending your emails. This permission ends when the card is deleted. Copies may remain in backups for a limited time.
  • No marketing without asking. We won’t use your card in our marketing unless you give us permission first.
  • You’re responsible for what you write. Make sure you have the right to use everything you include, and don’t share anyone’s private information without their permission.

Be kind

Kindnotes is for kind things. Don’t use it to:

  • harass, threaten, bully or intimidate anyone
  • send hateful, violent or sexually explicit content, or anything that sexualizes minors
  • impersonate someone, or mislead the recipient about who a card is from
  • share someone else’s private information, or content you don’t have the rights to
  • send spam, scams, phishing links or anything harmful
  • break the law, or help anyone else break it
  • copy, scrape, reverse-engineer or overload Kindnotes, or try to get around its security

We may disable a card that breaks these rules, without a refund. If you received a card you think breaks them, email kindnotesapp@gmail.com and we’ll review it.

What’s ours

The Kindnotes name and wordmark, the card designs, artwork, animation and typefaces, and the website itself belong to us or the people we license them from. You may use a card you’ve bought for personal, non-commercial purposes: send it, open it, save it as an image and share it. You may not copy our designs, resell cards, or use them to build a competing product.

If you send us ideas or feedback, we may use them without owing you anything.

Services we rely on

Kindnotes runs on services from other companies: Vercel (hosting), Convex (database), Stripe (payments), Resend (email) and DataFast (analytics). We choose them carefully, but we don’t control them. Our Privacy Policy explains what each one receives.

No guarantees

We work hard to keep Kindnotes reliable, but it’s provided “as is” and “as available”. To the extent the law allows, we don’t promise that it will always be available, error-free, or work on every device or browser. We also disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Limits on our liability

To the extent the law allows, Kindnotes isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data. This covers anything arising from your use of Kindnotes, including how anyone responds to a card. Our total liability for any claim relating to Kindnotes is limited to the greater of two amounts: what you paid us in the 12 months before the claim, or US$50.

Some places don’t allow these limits, so they may not apply to you.

If a claim comes from your card

Someone might bring a claim against us because of what you wrote in a card or because you broke these terms. To the extent the law allows, you agree to cover the reasonable costs that claim causes us.

Ending things

You can stop using Kindnotes at any time, and you can ask us to delete a card you bought (see the Privacy Policy). A deleted card is gone for good, and deleting it doesn’t entitle you to a refund.

We may disable a card or block access to Kindnotes if you break these terms, or when we need to for legal or safety reasons. Sections that by their nature should continue, such as ownership, limits on liability and governing law, still apply afterwards.

Changes to these terms

We may update these terms from time to time. When we do, we’ll change the date at the top. If a change is significant, we’ll also point it out on the site, or by email if it affects a card you’ve bought. A new version applies to anything you do after it’s posted. The version in place when you bought a card still applies to that purchase.

Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The United Nations Convention on Contracts for the International Sale of Goods doesn’t apply.

If something goes wrong, please email us first. Most problems can be sorted out quickly. If we can’t resolve it together, disputes will be decided by the courts of Ontario, Canada. If you’re a consumer, the laws where you live may give you the right to bring a claim in your local courts, or protections that a contract can’t change. Nothing here takes those away.

The fine print

  • These terms and our Privacy Policy are the whole agreement between you and us about Kindnotes.
  • If any part of these terms can’t be enforced, the rest still applies.
  • If we don’t enforce something right away, we haven’t given up the right to enforce it later.
  • You can’t transfer your rights under these terms without our agreement. We may transfer ours if Kindnotes is sold or reorganized, and this agreement would continue with the new owner.
  • We aren’t responsible for delays or failures caused by events beyond our reasonable control, such as outages at our service providers.
  • “Including” means “including but not limited to”.
